Terms of Hire

These terms of hire apply to the hire of dresses and accessories from Leiekjolen Studio via leiekjolen.no. Together with your order, confirmed by an order confirmation, they form the contractual basis for the hire. The terms follow Norwegian consumer legislation, including the Right of Withdrawal Act (angrerettloven), the Contracts Act (avtaleloven), the Marketing Act (markedsføringsloven) and the E-commerce Act (ehandelsloven); the principles of the Consumer Purchases Act (forbrukerkjøpsloven) on defects and delay are applied by analogy where relevant to a hire arrangement.

1. The agreement

The agreement consists of these terms of hire, the information provided in the ordering solution and any individually agreed terms, for example in connection with a studio fitting. In case of conflict, individually agreed terms take precedence, provided they do not conflict with mandatory legislation.

2. The parties

The renter (lessor) is Leiekjolen Studio, Thorvald Meyers gate 12, 0555 Oslo, Norway, email: hei@leiekjolen.no, phone: +47 21 00 00 00, hereinafter referred to as the lessor.

The hirer is the consumer placing the order, hereinafter referred to as the hirer.

3. Prices

All prices are stated in Norwegian kroner (NOK) and include VAT. The hire price covers the chosen hire period (4 or 8 days) and includes cleaning of the item after use. A deposit is charged in addition to the hire price, see clause 5. If the hirer wishes to keep the item longer than the agreed hire period, an additional charge per extra day applies, as stated on the product page, and on late return under clause 7.

4. Conclusion of the agreement

The agreement is binding on both parties once the hirer has submitted the order and the lessor has confirmed it. The agreement is nevertheless not binding if there has been a typing or keying error in the lessor's offer in the ordering solution or in the hirer's order, and the other party realised or should have realised that such an error existed. Orders must be placed at least 2 days before the requested pickup date.

5. Payment and deposit

The hire fee is paid by Vipps or payment card in the ordering solution and is charged at the time of ordering. The deposit amount is stated on each item's product page and is not charged at the time of ordering — by placing the order, the hirer accepts that the lessor may charge an amount equal to the deposit if the item is not returned in the agreed condition and within the agreed time, cf. clause 10.

6. Hire period, pickup and delivery

The hire period is normally 4 or 8 days, with shorter or longer periods available by agreement, from a minimum of 4 to a maximum of 30 days. The item is collected from the studio at Thorvald Meyers gate 12, Monday–Friday 11:00–18:00 and Saturday 11:00–16:00, or shipped to the hirer's address for a delivery fee disclosed when ordering. The hire period runs from the agreed pickup date, regardless of when a shipment is received.

7. Return and late return

The item must be returned to the studio by 18:00 on the last day of hire, or sent back with the enclosed return label that same day. The hirer must not clean the item — cleaning is included in the hire price. A late return incurs a fee of NOK 250 per day after a 24-hour grace period from the agreed return time.

8. Risk for the item

The risk for the item passes to the hirer once it has been collected or received, and passes back to the lessor once it has been delivered or received in return under clause 7. The hirer is responsible for the item throughout the hire period.

9. Right of withdrawal

Hire agreements concluded on leiekjolen.no are in principle covered by the Norwegian Right of Withdrawal Act. However, the right of withdrawal does not apply to services related to leisure activities when the agreement specifies a particular date or period for performance, cf. section 22 (m) of the Right of Withdrawal Act — which is the case for the hire of an item for a specific occasion within an agreed hire period. If the hirer nevertheless wishes to cancel, please contact the lessor as soon as possible; cancelling before the item has been shipped or prepared for pickup can normally be done free of charge, while a later cancellation may mean that all or part of the hire fee is not refunded.

10. Damage, cleaning and compensation

Ordinary wear and minor stains from normal use are covered by the hire price and the included cleaning. If the item is damaged beyond this, or is not returned, the lessor will contact the hirer before charging anything. The lessor may then claim the cost of repair and extra cleaning or — if the item is destroyed or not returned — an amount equal to the item's replacement value, as stated on the product page. The deposit under clause 5 is deducted from any such claim.

11. Fit and exchange

If the item does not fit, notify the lessor within 24 hours of receiving it. The lessor will then exchange it for the correct size if available, or refund the hire fee in full.

12. Delay and non-delivery on our part

If the lessor fails to have the item ready by the agreed pickup date, or it turns out to be damaged or unfit for use at pickup, the hirer may demand that an equivalent item be made available if one exists, or demand a full refund of the hire fee, provided this is not due to the hirer.

13. Defects in the item

If the hirer discovers a defect in the item at pickup or on receipt, the lessor must be notified immediately so the fault can be corrected or another item made available before use. Defects that could not be discovered by a normal check and are not due to the hirer entitle the hirer to a proportionate price reduction or a refund of the hire fee.

14. The lessor's rights in the event of the hirer's breach

If the hirer does not pay, or otherwise fails to fulfil their obligations under the agreement, the lessor may demand fulfilment, withhold the item on future orders, and claim compensation, late payment interest, reminder fees and debt collection fees for any outstanding amount.

15. Newsletter and marketing

The lessor only sends newsletters and other marketing by email to recipients who have consented to it, in accordance with the Norwegian Marketing Act. Consent may be withdrawn at any time via the unsubscribe link in the newsletter or by contacting the lessor.

16. Personal data

The lessor processes personal data such as name, address, email and phone number to process and deliver orders, together with order history, which is kept for five years under the Norwegian Bookkeeping Act. Data is shared only with providers necessary for operations, such as payment and shipping providers, and is never sold on. The hirer has the right to access, rectification, erasure, restriction and data portability, and may lodge a complaint with the Norwegian Data Protection Authority (Datatilsynet).

17. Dispute resolution

Complaints should be addressed to the lessor within a reasonable time. The parties shall attempt to resolve any disputes amicably. If this does not succeed, the hirer may contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation, phone +47 23 400 600, www.forbrukertilsynet.no. The European Commission's online dispute resolution platform may also be used: ec.europa.eu/odr. Disputes are governed by Norwegian law.
